NAFKAH ISTERI DAN IBU-BAPA; MANA YANG DIDAHULUKAN?

Soalan; Akum. Sy ada beberapa soalan.
1. Apakah hukum suami yg selalu mengabaikan nafkah anak isteri kerana mengutamakan keluarganya di kg? - Suami bukanlah anak lelaki sulung @ anak lelaki tunggal.
2. Bolehkah keluarga di kg terutama ibu & ayah meminta duit (terlalu kerap) dari anak lelakinya padahal anak lelakinya jg perlu bertanggungjawab pada anak isteri? - Ayahnya masih berkerja tetap selalu mengalami masalah kewangan.
Syukran jazilan atas jawapan yg diberikan.

Jawapan;

1. Dalam pemberian nafkah, seorang suami hendaklah mendahulukan isteri dan anak-anak dari orang lain (termasuk ibu-bapa). Urutan nafkah adalah seperti berikut;
a) Diri sendiri
b) Isteri
c) Anak
d) Bapa
e) Ibu
f) Cucu
g) Datuk
h) Saudara
i) Ahli-ahli keluarga berikutnya.

Urutan ini adalah berdasarkan hadis Rasulullah s.a.w. yang menegaskan; “Mulailah dengan diri kamu, bersedekahlah kepada diri kamu. Jika ada lebihan, maka untuk isteri kamu. Jika ada lebihan, maka untuk ahli keluarga kamu. Jika ada lebihan lagi, maka untuk begini dan begini; yakni untuk orang di hadapan kamu, di kanan dan kiri kamu” (Riwayat Imam Muslim dan an-Nasai dari Jabir r.a.. al-Jami’ as-Saghier, hadis no. 46). Berkata Imam an-Nawawi mengulas hadis ini; di antara kesimpulan dari hadis ini ialah; hendaklah pemberian nafkah dimulakan mengikut tertib yang tersebut (dalam hadis). (Syarah Soheh Muslim, juz 7, Kitab az-Zakah, bab al-Ibtida’ Fi an-Nafaqah Bin-Nafsi Tsumma Ahlihi Tsumma al-Qarabah).

Perlu disebut juga di sini bahawa nafkah untuk isteri wajib diberikan oleh suami sekalipun isteri kaya dan berada. Suami yang gagal memberi nafkah sewajarnya kepada isterinya -mengikut kemampuannya- ia dianggap berhutang dengan isterinya kecualilah jika isteri menggugurkan haknya dengan kerelaannya sendiri. Begitu juga, isteri boleh menuntut fasakh di atas kegagalan suaminya memberi nafkah.

Adapun nafkah kepada orang lain selain isteri, ia tidak wajib melainkan apabila memenuhi dua syarat;

a) Mereka adalah miskin, tidak memiliki harta dan tidak mempunyai sumber pendapatan. Jika mereka mempunyai harta atau memiliki sumber pendapatan sendiri, tidaklah wajib lagi ia menyara mereka. Namun digalakkan ia meneruskan pemberiannya kepada mereka untuk mengekal kasih sayang dan silaturrahim.

b) Ia mempunyai kemampuan untuk menanggung mereka; sama ada dengan hartanya atau dengan sumber pendapatannya. Kemampuan ini merangkumi kos saraan untuk diri sendiri dan isteri. Jika ada lebihan (setelah ditolak keperluan diri dan isteri), barulah ia wajib menyara ahli-ahli keluarga yang lain.

Merujuk kepada soalan di atas, tidak harus suami mengabaikan nafkah kepada isteri dan anak-anak dengan alasan ingin membantu ibu-bapa di kampung kerana menafkahi isteri dan anak-anak adalah wajib. Jika benar ibu-bapa memerlukan nafkah darinya, ia hendaklah menafkahi mereka tanpa mengabaikan isteri dan anak-anak. Itupun jika ia mampu menampung semua mereka. Jika tidak, hendaklah ia mendahulukan isteri dan anak-anak.
